Martin & Jones Investigates and Files Xarelto Claims
More than 9,000 cases involving injuries or death caused by Xarelto have now been filed in state and federal courts against the manufacturer Bayer AG and its U.S. distributor Janssen Pharmaceuticals, a subsidiary of Johnson & Johnson. Xarelto is a blood thinner that has been associated with severe, irreversible internal bleeding that typically occurs in the gastrointestinal tract or in the brain. According to the Food & Drug Administration which oversees the safety of pharmaceuticals, over 10,600 Xarelto users have reported injuries which required hospitalization or resulted in death since it came on the market in 2011.
Approximately 7,000 Xarelto cases have been consolidated under the supervision of a single federal judge, the Honorable Eldon Fallon, in an MDL (multi-district litigation), in the Eastern District of Louisiana. Multi-district litigation is an efficient, cost saving procedure available in federal courts when multiple lawsuits involving similar allegations of negligence are filed against the same defendants. While the Xarelto cases are consolidated for discovery, each individual case is worked up and individually tried to a jury, since the facts and law relevant to one case may not apply in another. All plaintiffs with cases in the MDL have the advantage of shared discovery on general liability issues so that plaintiffs’ lawyers don’t have to “reinvent the wheel” in every case to assess liability, which again results in significant cost savings to the plaintiff.
